Closing Statement Foreword

After prayer and sleeping on it, I decided to share my closing statement with you but first, I have to explain a few things and know that I copied it word-for-word from the same Word document I had printed it out from.

Second, this was written under oath so it had to all be true or I could face criminal charges for perjury and this document confirms much of what I have previously told you. I knew when I was writing this that they would probably research everything I said in hopes of catching me on something to bring charges for perjury against me so I reviewed it a number of times to make sure it was all accurate.

Third, I need to be more specific about beating the attorney in arbitration who is known to be the best in the history of this city. It was the first time the city came after me with him representing the city more than 20 years ago (meaning I just beat the city twice without legal counsel), almost certainly before this city judge and DA were practicing law so they probably never heard about it and you know he didn't go around bragging about it.

You can bet they know about it now and he (now a state judge) probably advised them on my closing statement and told them to dismiss the charges, hope it goes away, and leave me alone.

At that time, before that arbitration, I had a number of people warn me in an effort to get me to obtain legal counsel. They told me that only one person had beaten him in arbitration and that person had legal counsel so you can see their concern. Of course, they didn't believe anyone could beat him without legal counsel.

But I know the law, I was in the right, and I knew the law was on my side so I went into arbitration against him without legal counsel and became the second person to beat him in arbitration and the first to do it without legal counsel.

In the below closing statement pay attention to the fact that my defense was based on a combination of Constitutional law and science and you can bet they would have had someone with a degree in science, like a New Mexico State University Science professor, review and confirm everything I said concerning science. They would have probably had to have two or more science professors from different fields of study confirm all of the science in the statement because very few college professors are knowledgeable concerning two or more fields of science and I wrote about science from two or more fields of study.

Also note that I pointed out that much of what they were doing was unconstitutional and, therefore, a federal felony, which means that, if I took this to the State Supreme Court or a federal court, they would have been put under investigation and almost certainly gone to prison. That is just a wee bit of motivation.

They would have also checked my medical records to confirm my statements about my health problems in hopes of bringing charges against me for perjury and I would not be surprised if at least one MD asked, "Is he still alive?"

Also, I learned quite a bit from this event and stated such in the statement, which is why God put me through it and has me wondering what He was preparing me for. You know it won't be fun.

There are a number of reasons for me to share this closing statement and one big one is to help you better understand your rights and Constitutional law because you may soon need it.

One very important lesson here is NEVER assume that someone is ignorant, stupid, or lazy because they are poor. That false concept was dreamed up and is taught by arrogant, ignorant pagans to make themselves feel superior to people who are not as wealthy as them, you know, you peasants, and it is also their false security blanket because their flawed logic is, "Since only ignorant, stupid, and lazy people are poor and I am not poor, therefore, I am not ignorant, stupid, or lazy, therefore I do not have to worry about becoming poor," which is false.

Research has shown that better than half of today's homeless, living on our streets in the US, have at least one college degree and some of them have Ph.D.s and MDs. Some of them are more knowledgeable than most of the arrogant rich people.

That lie was dreamed up by pagans for arrogance, a false sense of security, and to disprove the Bible but reality disproves that lie and proves the Bible. The Bible says God is in control, not you and crap happens.

You think I am wrong? How many of you have gotten sick at least once in your life? What? You, in complete control of your lives, couldn't keep yourself from getting sick? If you think you are in control of your life, why don't you stop all of the wars right now?

That alone proves the pagan false security blanket to be a lie.

God often uses us having problems to teach us things. He let me marry a gold digger who used an attorney to steal my sports program and business, which is the only reason why I went back to college to study law because I knew would need that knowledge of law to protect my future sports programs and God knew I would need that knowledge of law to protect myself, living here in poverty because of my prolonged illness, from a corrupt city.

Do you see how God often works. He protects us by guiding our feet, often by shoving our stupid butts in the direction He knows we need to go.

It was the will of God that I end up here doing what I am doing and definitely not what I want to do but I also know He is preparing me for things that He told me are to come. That arbitration and court case were just lessons in life to prepare me for more life.

Therefore, below is my written closing statement to help some of you.

Forward

First and foremost, I intentionally permitted this to go to court because I became aware of violations concerning the US Constitution pertaining to this code enforcement program. My plan was to bring it to the attention of the judiciary because, in our Republic, the judiciary is the branch of our government most responsible for maintaining the enforcement of the US Constitution on the government to prevent such abuses of power by the government over the people. In this regard, the judiciary is the most important branch of our government for enforcing the US Constitution.

The primary responsibility of the judiciary in our government is to maintain the contract between the people and the government called the US Constitution to prevent abuses of power by the government over the people and our government is in massive breach of contract for a number of reasons.

I knew there were minor infractions by code enforcement for more than 20 years but I was preoccupied fighting for my life with my prolonged illness, which plunged me into poverty.

In the Spring of 2022 the City of Alamogordo became much more aggressive in grabbing for and abusing power to control the land to control the people so I went around talking to the people in this area, mostly poor people, about them organizing to stop these abuses of power but quickly learned that none of them knew enough about law or science to defend themselves in court and attorneys cost too much for poor people and only care about money so the people were forced to just pay the fines and roll over, permitting the city to abuse their unconstitutional power even more.

I realized that, if the city cited me for their unconstitutional code violations, I would have to use my knowledge of law and science to put myself at risk by taking it to court to expose these abuses of power to the judiciary to fight for the poor, who cannot fight for themselves and are being abused by this corrupt government and that is what this court case is really all about.

When I first started out, I was mostly fighting for the poor but have since realized that this is much, much worse than I had initially thought so now I am fighting alone for everyone who owns land in the City of Alamogordo because most people, even most rich people, don't realize what is going on.

This case is really not about plants or debris like they keep trying to keep you focused on because they don't want you to see their abuses of power but about how terribly unconstitutional their power and money making racket is and they know I know about that. This case is about upholding and enforcing the US Constitution to protect the people from abuses of power by the government.

The appearance of property cannot be as important as the US Constitution. Without the enforcement of the US Constitution, we cannot have a constitutional republic.

At 2pm on February 2, 1972 I swore an oath to uphold and defend the US Constitution and to protect the people from both external and internal threats that has no expiration date and I am doing my best with my bad health and poverty to keep that oath because I was taught that a man can be no better than his word. Someone has to help the poor.

Clandestine Operation

What the city has done is unconstitutional but you have to respect the legal genius of their program in a number of ways, while showing their scientific ignorance. It was what the US Military would call a clandestine operation.

It appears to have been designed after the unconstitutional British Royal Surf System our Founding Fathers fought a war to get out from under, where the Royals used control of the land to control the surfs and slaves. Under the British Surf System the Royals could fine you, drive you off the land and make you homeless, throw you in jail, and destroy you by controlling the land. You did whatever they said or else and they could make up laws and charges on the spot to make an example of you. The people were completely at the mercy of the Royals because the Royals controlled the land.

One of the most brilliant things the city did with this system was to choose the code enforcement program as cover for setting up their tyranny over the people because I found that those involved in law enforcement don't take code enforcement seriously, they don't think there can be any serious violations of the Constitution, and won't even checkout what is going on so this permitted to city to "fly under the radar" of the judiciary system so their corruption won't be noticed. The judiciary was too busy taking care of "more important matters". It is brilliant.

When I checked from here to Albuquerque I could not find one person in law who considered civil legal matters significant enough to even take a look at what is going on so the city could do whatever they want without fear of their unconstitutional behavior getting any attention from the judiciary. It is the perfect cover and makes me wonder how many years or even decades these abuses have been going on and I know it has been going on for more than 20 years, since before I returned to Alamogordo.

In dealing with this problem I realized that my first task is to get their unconstitutional behavior up "into the radar of the judiciary" so the judiciary will realize the problem and be able to do their job in stopping the abuses of power by the city.

Program Function

The program structure is complex, genius, and designed to be deceptive to confuse and fool anyone with bogus science who has not studied college science, especially judges. They want to keep the judges thinking it is just about plants and debris so they won't notice what is really going on to think about the US Constitution.

The more I have been involved in fighting this program to stop its abuses, the more stunned and impressed I have become at its legal genius, while seeing some pretty incredible corruption and scientific ignorance.

In the city court I kept pointing out that a number of things were unconstitutional and, every time I did, either the judge or DA would rudely interrupt and change the subject. NOT ONE TIME did either of them question or debate that what I said was unconstitutional was or was not unconstitutional so I was getting a strong feeling that they know their program is unconstitutional, when the judge confirmed it, after I pointed out that something was unconstitutional by him saying, "These are our laws, if you live in Alamogordo, you must abide by them."

The message was very clear that 1) they know their program is unconstitutional, 2) the US Constitution does not apply in Alamogordo, 3) you do not have any constitutional rights in Alamogordo, and 4) they can unconstitutionally make up whatever laws they want and you will abide by them or else, just like the British Royal Surf System.

Then he told or threatened me that HE, the judge, can fine me up to $500 per day every day indefinitely and can send me to jail for up to 90 days, purely at his discretion, you know, just like the British Royal Surf System. This is not the innocent code enforcement program everyone thinks it is, which is why I am trying to bring this to the attention of the judiciary so they can take care of it, but it gets much worse but, first, let's do the math on what he told me really means.

If he fines me $500 per day for just 30 days, that is $15,000 per month, which the poor people in this city, including me, cannot pay and, if he fines me $500 per day, every day, and sends me to jail for 90 days, by the time I get out of jail, I will owe the city $45,000, which most people in this city, including me, cannot pay. There is no limit to what they can fine you. They can use the system to destroy you, if they so choose, just like the British Royal Surf System.

If they fine you enough that you cannot pay the fine, they can use that to justify seizing your land and selling it for the unconstitutional fines they levied against you, making you homeless and destitute, you know, just like the unconstitutional British Royal Surf System.

In the City of Alamogordo, you technically do not own your land; the City owns or controls your land, permits you to live on it as long as you have their permission, and you pay the taxes on it because the City has absolute control over all of the land in Alamogordo with their code enforcement program. It is brilliant and deceptive.

Also, it is a great way to levy taxes on random people or whomever they want without the people realizing they were just unconstitutionally taxed.

Let me give you a few examples.

If they fine you $500 per month for 12 months, that is $6,000 per year in city land taxes and, if they do that to 1,000 land owners, of which there are more than 10,000 land owners in Alamogordo, that will be $6 million dollars generated in revenues for the city in just one year with city land taxes, which is just a wee bit of motivation for corruption.

It is an easy and deceptive way to increase taxes or city revenues on random people by making them believe they did something wrong. If the city wants another $5 to $10 million dollars, they just send the code enforcer out to write up a bunch of people by making up whatever charges they want until they get the money they want.

Then I told the city court the biological definition for a weed, which is that "any plant on your property that you do not want on your property is a weed and any plant you want on your property is not a weed" and the judge told me, "The definition for a weed is vague and it is whatever we want it to be," telling me that their code enforcer can pick any plant in any yard, say it is a weed for any number of reasons and they can write you up for it, giving them unconstitutional absolute control over every property in Alamogordo and them using control of that property to control the people, you know, just like the British Royal Surf System.

The full impact of that didn't hit me until we were in the state court and the DA provided us with copies of the codes and the definition of a weed included but is not limited to: rank, noxious, poisonous, harmful, unhealthful vegetation, or any growth whatsoever of an offensive or unsightly nature.

All they have to do is CLAIM any of that and any plant can be classified as a weed and you should know that better than 90% of the plants on this planet, if consumed by humans, will make you sick or kill you, therefore, they are "noxious, poisonous, harmful, and unhealthful vegetation". That includes almost all plants growing in people's yards and being sold by businesses.

They even listed that trees can be listed as debris.

Basically, they can send the code enforcer to write up your property and he can pick any vegetation, claim any of those or other things, and, by their laws, that is a weed and they can write you up. They can use those vague terms and definitions to claim a rose bush, a tree, or even just your lawn is a weed because they claim it is unhealthy and they can write you up. It is brilliantly done and I was stunned.

For example, the DA was trying to include my firewood pile as debris when the judge realized that her firewood pile could also be written up as debris so the DA quickly backed off and began distracting her to some other made up violation. That other made up violation was a small dead tree on my property that the DA claimed was an "unhealthy dead tree", implying that it causes health problems, and, when the judge stopped to consider that, the DA quickly added that all dead plants are "unhealthy dead plants".

I don't know if the judge realized that, if dead trees can be written up as "unhealthy dead trees", her firewood pile can also be written up as unhealthy dead trees because firewood is also dead trees. As a matter of fact, her home, her furniture, her wooden shed, her children's wooden toys, anything else in or around her home that is made of wood, and all of the lumber at Lowes and Home Depot can be written up as "unhealthy dead trees" because the system is designed so the city can make up and claim anything they want and it is law in violation of the US Constitution.

The city has given themselves far too much power and they are massively abusing it.

Since I began studying college biology in the spring of 1968, I have not heard one biologist refer to dead vegetation as unhealthy because it is actually considered to be very healthy because all dead plants decompose or compost down into biomatter, which is plant food.

You see, when a plant or tree grows, it takes nutrients out of the soil so that, when it dies and decomposes, it returns or recycles those nutrients back into the soil for future plant growth plus plants don't get all of their nutrients from the soil and even make some of their own nutrients via photosynthesis, when the sunlight hits photosynthetic cells in the plant, causing it to make nutrients for plant growth so that, when plants compost in place, they are recycling all nutrients they took from the soil plus adding nutrients they made from photosynthesis into the soil, enriching the soil even more than it was before that plant grew. Therefore, all dead plants are very health for the soil.

If I am wrong, why do people put peat moss, which is just dead plants, in their yards and gardens for plant food? Why is peat moss or dead plants considered by everyone to be healthy?

For example, I have been using my knowledge of science, especially that information, and indigenous vegetation to "grow" my formerly dead soil into significantly more healthy soil by using the plants composting in place to increase the nutrients in the soil naturally.

This is just one of many potential examples of how, with this system, the city can claim anything, regardless of whether it is true or not, and impose it on any property in town as law, which is clearly unconstitutional. They are blatantly abusing the power they unconstitutionally gave to themselves and that power needs to be given back to the people where it belongs.

In college freshman biology, they teach that there is an average of 3 feet of biomatter or dead plants on the continents of this planet, without which there could be no life on this planet because those dead plants are food for live plants, which are food for a variety of organisms, which are food for predators so that all life on this planet depends either directly or indirectly on that biomatter or dead plants for food. It is scientifically impossible for dead plants to be classified as unhealthy, when all life depends on those dead plants to survive.

Clearly, the idea of all dead plants being unhealthy was something the DA just made up in court to justify bringing more false charges against me.

Listen, I have several smaller dead trees I am using for décor in my cactus garden just like millions of people all over this nation use dead trees for yard decor and, as those dead trees lie there in that garden, they are slowly composting down, providing those cacti with nutrients for growth. They are a decoration that provides the garden with plant food for better plant growth.

They are not unhealthy dead plants and they are not debris.

I have been wondering where I want to put that "unhealthy dead tree" for decor and increased plant food for better plant growth. Until then it is composting in place, returning to the soil the nutrients it took from the soil for better plant growth in that place. Hey, I could cut that "unhealthy dead tree" up and use it for firewood.

Do you see how the city just makes up stuff so they can charge you with a code violation or crime and it doesn't even have to be true?

They can make up ANYTHING they want and just claim it is true, which in a court of law is perjury. If I were to make up anything I wanted and say it in a court of law, that would be perjury.

After everything I have seen, been told, heard, and read, I am convinced that, if your yard had nothing but dirt in it and they saw a rock, they could claim the rock is debris so they could write you up because, just like with weeds, debris is whatever they say it is.

Know that I know how to use science to do things naturally and my illness induced poverty does not make it possible for me to do things the way the oppressive government dictates I must do those things, so I use science to do things naturally. I don't just waste things by throwing them away; I recycle or reuse everything I can because I know how to use science to do that and I am a responsible person.

One thing that really stunned me in the state court was when the judge dismissed all of the charges against me concerning vegetation and the DA mocked her in her court by immediately saying, "I can write him up every month."

The DA told us that she didn't care about or respect the judge's decision to dismiss any charges because their system is brilliantly designed so she can make up any charges she wants and write me or anyone else up every month for as long as she wants. Their system was designed so that, as long as the judge is kept focused on plants and debris instead of the US Constitution, it does not matter what the judge judicates because the city can just make up more charges and write up anyone and everyone they want any time they want giving the city absolute control over all of the land and over the people in Alamogordo.

Also, the DA mocking the judge in her court told me that this has been going on long enough and they have been successful enough that the city has become confident enough to feel free to ignore the court's decisions and be able to continue to do as they please, giving them absolute control over all of the land in Alamogordo. They have brilliantly found a way to negate court decisions so the judiciary doesn't matter to them as long as the judiciary does not deal with the constitutionality of their program.

I learned that day that the old saying of, "If you give them a foot, they will take a mile", grossly understates the City of Alamogordo because, if you give them an inch, they will take infinity because they can make up and write charges against you indefinitely. Their power and control over the land and the people has become far too extensive and is blatantly being abused to the point that they feel they can mock a state judge in her own courtroom and ignore her decisions and, if they keep the judge focused on plants and debris instead of the US Constitution, they can.

The only way the judiciary can stop that kind of abuse of power is to focus on the US Constitution instead of plants and debris and declare their entire program to be unconstitutional to bring a halt to the entire program and I will address that further at the end of this statement.

I am still stunned by the DA mocking that judge in her courtroom. That DA should be held in contempt of court.

I have learned that the City program is built around money and power and it is not just designed and managed to make the city money but also oligarchs that have businesses in the city. I have learned that, if your property appearance benefits either the oligarchs or city financially, then it is code compliant.

They brilliantly designed the system to increase profits for the oligarchs by branding all indigenous vegetation as weeds so you cannot grow them in your yard. This also causes people who have not studied biology in college to not realize that what they are really doing is branding indigenous vegetation as weeds so you can only grow invasive species you purchase from the oligarchs, without realizing they are invasive species because most people just think they "are not weeds". The military calls this psychological warfare against the people.

This forces the people to buy their invasive species from businesses owned by the oligarchs, which makes the oligarchs more money. Since those invasive species are also rarely drought or heat tolerant they tend to die in this high altitude desert, which makes the oligarchs more money because you have to buy replacement plants from them.

Then most of those invasive species tend to not grow as well or at all in the local soil, especially in "Walker Town" south of highway 70 and west of highway 54, so you are also required to buy replacement soils for hundreds to thousands of dollars from the oligarchs, which makes them more money, and you have to buy fertilizers and plant food for hundreds of dollars from the oligarchs, which makes them even more money, especially when you multiply that out for thousands of homes.

With all of that, most of those invasive species are not drought tolerant so you have to put much more water on them, hundreds to thousands of dollars of water per year, in a high altitude desert with enough of a water shortage that they force you to ration water every year but that is OK as long as it makes the oligarchs more money.

So what if you eventually increase water usage to where you run out of water turning Alamogordo into a ghost town like Claunch, NM? Does forcing people to buy and grow invasive species, which require a lot of water in an area where they have to ration water, make sense to anyone?

Note that, in Wild Life Management, we studied Claunch, NM, which had been a town of 15,000 until they ran out of water. The last I heard, there were only 8 to 10 people living there.

You see, the program isn't just designed to make the city more money, but is also designed to make the rich oligarchs more money and I will address this further when I explain the science behind how we should live in such a desert, which is the exact opposite of what the City dictates how we must live in this desert.

This program is intentionally designed to confuse and fool ANYONE with bogus science who has not studied college level science and they did a really fantastic job of putting it together. It is brilliant AND unconstitutional and they have designed the program so they can destroy almost anyone with it.

Note that the expense of growing their required invasive species in Alamogordo, especially in Walker Town, is prohibitive to the poor, discriminates against the poor, and is unconstitutional to force it on the poor.

The Fire

Now I need to address the current pending charges against me concerning the matter of a fire on my property.

First, we have to start with a little history so you better understand me, where I am coming from, and where I am going.

My grandfather was a county sheriff in Eastern New Mexico, when he rode a horse and carried a Colt 45 on his hip. He taught me to respect and work with the law but that there are good cops and bad cops so, any time you work with the law, you better watch your back.

In the fall of 1967 I informed the FBI of some dope pushers in Albuquerque and even tried to make a buy for the FBI while they waited outside in their car but the pushers already knew from some of their clients that I was straight so they wouldn't sell to me. The agents told me they would take care of it and I read in the paper about 5 or 6 months later that they got two of the three pushers because the third one had left for California just days before the bust.

When I started college at UNM in the spring of 1968, I started out studying mechanical engineering but didn't want to build bombs, bullets, or missiles to kill people so I changed my major to help young people while continuing to study the hard sciences. I love the satisfaction of helping people.

I also love the hard sciences and hate bogus science but didn't get a degree in the hard sciences because it was well known in college that most of the jobs you would get with such a degree would be working for or paid by the government or chemical companies and, "if you didn't tell the lies they tell you to tell, you got a job working for MacDonald's" and I hate lying. I just wanted to help young people.

In February 1972 I went into the US Air Force in ECM, which required more classified training and knowledge than any other career field I know of in the military. SAC gave us classes on espionage for gathering and analyzing intel to figure out what is going on and, in combat, you better do a good job or it can get you killed.

After I got out of the military, I got a temporary job managing apartments east of the State Fair Grounds in Albuquerque, which, at that time, was the highest crime area in the city so I quickly started working with the Albuquerque Police. It turned out that the leaders of a gang were living in some of my apartments and I got to know them pretty well.

After a little over a year, I was informed by one of their gang members that their leader had put out word that, if I did not leave the area, I was to die so I moved my family to a safer neighborhood.

Following my divorce, in 1983, I moved to Los Angeles, where I started the Los Angeles Racing Team for bicycle road racing with an open door policy that, if you joined the program and did what I said, you got coaching. I started by only recruiting beginners, including juniors (under 18). I have a proclamation from Los Angeles Country hanging on my wall for the work I did in keeping young people out of gangs, drugs, and crime and, independently of each other, 4 different LAPD joined my program over a period of a few years and they all told me that the reason why they drove by a dozen or more other programs to join LART was "because it was well known in the LAPD the work I did to keep kids out of gangs, drugs, and crime." I literally saved kids lives and I will give you two short examples.

When 15 year old James Senior came into my program, I checked with his parents to make sure it was OK with them for him to be in my program. His two divorced parents and their two lovers, all 4 told me that "Everyone who knew him knew that he would be dead or in jail by the time he was 18." He was just a wee bit of a problem.

Two years later he was easily the best Junior racer in the US consistently beating the best Juniors who had been racing 4 to 6 years. He later raced in Europe for a while, met a pretty Belgian girl, they got married and made two more pretty Belgian girls. He is now working as a welder for big company in Belgium because he met the wrong coach, who changed his attitude.

A few years after James turned 18, Damon Jackson's mother brought him to my program because she "had heard about me" from almost halfway across the LA area. She was terrified and asked if we could talk outside. She was a single working black mother living in South Central LA, gang city, and 15 year old Damon had started hanging out with gang bangers. She asked if I could help and I told her that, if she kept him coming to my program, I would do the best I could.

1.5 years later, Damon was the best Junior in the US with a powerful Junior team backing him, all trained up from beginners. When I left in 1993, he wasn't in a gang, using drugs, selling drugs, dead in the street, or in prison. He was a junior at UC Santa Barbara because he met the wrong coach, who changed his attitude.

Remember that, if I can help kids in LA, I can help kids in Alamogordo and that is what I was working towards doing before the fire, after I managed to recover from my illness enough and we will get back to that because that is an important part of this case.

My wonderful second ex-wife and her greedy attorney set it up behind my back for her to legally steal LART from me while I was on a road trip in 1990. I thought about it and knew that, if I fought her for LART, it would just make it worse for everyone, my riders already knew how to race and train so I cut them loose for them to ride for teams that could get them to the top races.

I decided to return to college to study law so I could protect my future programs and also get an M.B.A. so I could better deal with team and event sponsorships. I had a dream of saving my money coaching in Europe, retire, return to either Albuquerque or Alamogordo and set up a program coaching and helping kids for the fun of it. Helping kids was my idea of retirement.

Just before I left LA I was informed by a member of the 60th Street Gang in South Central LA, one of the 5 most violent gangs in Southern California, that he "had been given the privilege of being the one to get to kill me" and I would be the first person he would kill in the next riot. The gangs don't like you turning kids into good people. Gangs really don't like me.

I got accepted to a university in Paris where I could take an emersion semester in French, spend two years getting my degree, while working in the professional racing industry in France to make money and get me well established in European pro racing but my wonderful first ex-wife dumped my teenage daughter on the streets of Albuquerque with the state not giving a crap.

The state wouldn't let me take my daughter to Paris to learn one or more other languages and get a more diverse education and living experiences because they "had to keep control of her", you know, so she could keep living on their streets. Being responsible, I moved to Albuquerque to get my degree at UNM so I could take care of my daughter. People are more important than anything else, which is why the US Constitution was written to protect the people from the abuses of power by the government.

By the time I finished that degree, my health was failing because of a virus I got from my lovely second ex-wife because she couldn't keep her panties up and there was no way I could handle the rigor of being on the road all of the time with a pro racing team so I started trying to get other work.

At one time I was registered with 8 head hunters trying to find work but, at that time, there was a fad in the business world to not hire people like me with experience because they all wanted cheaper labor to increase profits.

In December 1997 my mother died in Alamogordo and in August 1998 I moved down here on her property with my health still declining but no one would run tests on me to find out what was wrong. One doctor told me the insurance companies had lists of doctors and, if any doctor on their list ran a test on anyone "who was not bleeding and found something the insurance company would have to pay for", they would black list that doctor, you know, so the insurance companies could increase their profits at the expense of their clients.

I got so sick that, for about 1.5 to 2 years (about 15 years ago), all I could do was sleep 15 to 20 hours a day, fix one or two TV dinners for meals and just sit in a chair and stare at 4 walls. I was almost dead.

My illness finally plunged me into poverty so Ben Archer helped me get on Medicaid, which would pay for my tests. It took us six years of running tests to find out everything that was wrong with me because I had not been able to get medical treatment before and had been sick for so long. They ran every test Medicaid would pay for and found I literally had a dozen things that kill people every year with a number of the medical people telling me I should have died years before.

Just before that fire I was 72 with my health barely recovering so I started setting up that shed that burned down to be a club house I would call "Pop's Bikes" to teach local poor kids how to work on their bikes while teaching them to dream and how to achieve their dreams to keep kids out of drugs and crime, when that jerk burned it and my last dream down.

Everything got interesting because of that fire.

That night I was in bed between 11 PM and midnight when someone (about 4 or 5 people) beat on the back of my trailer yelling that my house was on fire and I better get out. I sat up on the side of my bed towards the back of my trailer where I could look the full length of my 80 X 14 foot trailer and there was no light or smoke. The house was not on fire. I put on my shower clogs, walked about 40 feet to the front door, down about a 50 foot wheelchair ramp to the back of my trailer, 80+ feet to the front of my trailer and there was still no flames, just my hedge smoldering but I didn't have any way to put it out, which told me that the fire had just been set about the time those people beat on the back of my trailer so they probably either set it or saw who set it. I never got a good look at them in the dark.

Then I heard the fire trucks heading down Collins toward my home and they got about 3 or 4 blocks away when the hedge finally burst into flames and then lit up my shed, while I was gathering all of the intel I could because there was nothing else I could do.

A number of years ago, a neighbor's house caught fire 4 lots from my home and I went down to try to help but I was just too sick to do much other than watch. The one fire truck from the station at the end of Walker Road got there in about 10 to 15 minutes with just one fireman and he started rolling out his fire hoses while we tried to rescue a woman inside the double wide. It took at least another half hour for another 3 or 4 trucks to get there and for the volunteer firemen to get there and get their gear on before they finally sent the first team of 4 into the building to fight the fire. The woman died.

The night of my fire, 4 to 5 trucks all showed up at the same time with all of the firemen (mostly volunteers) in their gear in just about 10 to 15 minutes. The ONLY way that was possible would be if those trucks were all at the Walker station with the men in their gear waiting for that fire. Something wasn't right and it got worse.

After they quickly put out the fire, a fireman came over and started looking over the scene. I started talking to him and he told me he was the Alamogordo fire detective. He told me they knew who started the fire, didn't have the evidence to prosecute them prior to my fire, and they had set a number of fires in the area telling me that this person is a real threat and needs to be gotten off of the street to protect people before they kill someone. He also told me this person was what I call a "yard Nazi" and most people call snitches who complain to the city about other people's property to cause trouble for other people because they get a power rush from causing trouble for other people.

Within a couple of minutes a woman, who owned the house across the alley from mine came over with her son and his family who were living in that trailer with none of them wearing night clothing at midnight (she lives somewhere in town) and told me she was the fire detective's mother, she had a bunch of tools, she would cut down all of the vegetation in my yard, and she was trying to sell her land that was next to mine.

Her son told me the fire was a terrorist attack (a federal felony) and that the people (plural - the arsonist was a member of a local group) who did this were working with a gang from Mexico, probably a cartel, so this could be an international crime. Both of those crimes are under the jurisprudence of the FBI.

I was gathering intel but trying to give everyone the benefit of the doubt, figured the detective would gather the only available evidence to investigate the crime, you know, the material that was used to start the fire, and went back to bed after midnight, when there was nothing else I could do.

A few days later, I was out there and saw something laying the concrete pad in front of my trailer, where I had stood during the fire, that had not been there before. It was a one inch brass Christmas bell that had been pried open and stuff with some material, then pried shut, with about a one foot piece of weed eater cord tied to the back of the bell to throw the bell with and the material inside the bell had been singed the way an alcohol fire would singe it.

It really helps to study science in college.

It was very obvious that someone had staged a second arson attack on my house by lighting the device, throwing it at my house, it bounced off the house, and landed on the open concrete, where it burned out.

I called the fire department, the detective came out with an aid, they took a picture of the device, took the device with them, and I have not heard a word from them in 1.5 years. Hey, good investigations take time.

A week or two later I decided to look over the fire area and, to my amazement, found that the only evidence for investigating the fire was still there so that no one took the only evidence to investigate the fire so it is not possible for anyone to have investigated the fire.

What they should have done was take that evidence to a lab, tested it for the obvious accelerant that was used to find the identifier molecules in the accelerant to find out where and when it was purchased to help them find out who started the fire. It was obvious the city did not WANT to investigate that fire so, with a second attack using the bell and the city not doing their job to investigate the fire, I knew I had to maintain the integrity of the crime scene while finding someone who would investigate the crime.

I tried to give the city the benefit of the doubt because it is a small town with limited resources but realized that they could have sent that evidence to labs in El Paso, Las Cruces, or Albuquerque. They just didn't want to do their job.

I still have the only evidence that could have been used to investigate that fire today. No one has investigated that fire. Either the DA was lied to, didn't know better, or committed perjury in your court when she said the crime had been investigated and closed because it could not have been investigated and, if you want to see that evidence, drop by and I will gladly show it to you.

I also noticed that another part of my hedge had died, looking like someone either poured and sprayed something on the ground to kill the hedge so there was a possible 3rd attack. These continued attacks concern me.

I realized I needed to get this person or group of people caught and put in prison to protect me, protect others, and be able to litigate for damages so I could buy a replacement shed and tools for my club house to help kids. Therefore, I had to maintain the integrity of the crime scene until I could get someone to investigate the crime because the city wouldn't do its job.

If the city had done its job, I could have started fixing up the site more than a year ago.

Recalling that the fire detective said it was a terrorist attack and possible international crime and knowing the city was not going to do their job to investigate the crime for some reason, I called the FBI and reported the intel about the fire being a terrorist attack and possible international crime. I never heard back from them.

But I decided to give them time because I know it can take from months to years to investigate a crime properly. It is possible they were working on a related crime in my area and would get around to investigating it as soon as they could.

The next spring I noticed that my Spanish grass on the north side of my property didn't come back well from being dormant over the winter the way the rest of it did in my yard and it looked like someone may have put a chemical on it too so I posted a "tip" about the fire being a terrorist attack on the FBI web site but never heard anything from them again either. I couldn't find anyone in government who would do their job to protect the people.

What are we paying these people for?

At the same time last spring the city reorganized their code enforcement and became much more aggressive at controlling people's property to control the people and to make money from the people. I already explained that above.

The city wrote me up early that fall and I started fighting it in court to put an end to their unconstitutional program. I decided to call the FBI again to see what was going on with my previous reports and they said they were not responsible and didn't want to do their job, which is why I later asked the state judge if she could help me get the FBI to investigate the fire crime but she said she can't.

I don't care what the city says, they can make any unconstitutional and invalid claims they want, the crime could not possibly have been investigated because I still have the only evidence they could have used to investigate the crime. Those cinder blocks are not "debris" just because they say so, those blocks are the foundation for the shed that burned down and for the replacement shed when I get the money to buy one. I already explained why the dead tree is not an "unhealthy dead tree" but is part of a crime scene that is composting nutrients back into the soil that were burned up by the fire to regenerate the soil naturally and probably to be used as decor after the crime has been investigated to continue improving my soil. The ash is already being composted into the soil to replace the nutrients the fire destroyed and the rest of the materials will be used to build a new work bench in "Pops Bikes" club house to help kids, when I can get the money to buy a replacement shed.

You have to understand that for me to use something like "Crowd Fund" online to buy a new shed and put it on those blocks would compromise the crime scene so I have to wait until an investigation is done to get those criminals off the street, which no one wants to do.

Plus, what good would it have done for me to come up with the money to buy a replacement shed with the arsonist, who staged at least 2 attacks against me, still out there to burn the replacement shed down next?

It only made sense to get the arsonist before putting up a replacement shed.

I did not commit any crimes by trying to protect myself and others the best way I knew how with no help from anyone else. The City of Alamogordo committed the crimes by being derelict of duty in not trying to protect the people. In 1.5 years, they never contacted me about the fire to let me know what was going on.

Snitches

The city has created an extremely dangerous situation in Alamogordo by "greasing the squeaky wheels" of people commonly referred to as "snitches" that has gotten out of hand and must be stopped and this is an important part of the problem I am fighting.

If you study history, all dictatorships function by using snitches as valuable tools to report on the people so the government can abuse those people to control the people. A very big problem with this is that the snitches power trip every time they abuse the government power to cause trouble for other people and that causes them to keep getting more aggressive until they become violent and, in dictatorships, they often end up killing people for the government.

When I first got back to Alamogordo, I found out from other people AND the city government that the city was using snitches and it was already clearly getting out of hand.

I don't know how many times I have seen these psychopathic people driving up and down streets they don't even live on at 3 to 5 mph pathetically inspecting other people's yards by stopping in front of every yard looking for anything they can complain to the government about to cause trouble for those people, which is stalking, harassing, and terrorizing those people with the city being complicit in those crimes because they were encouraging them to commit those crimes by "greasing the squeaking wheels". I have had some of these people pull up in front of me, roll down their car windows and laugh at and heckle me because of the power they had over me by being able to call the city and complain about anything they wanted. They knew the city would come out and bully me for them.

A number of times code enforcement showed up because of complaints about my property by these snitches, told me they did not see the stated infractions, and said they still had to do something to appease the people who complained.

I found out from my neighbors and the city that the snitches formed a group shortly after I got here to have regular meetings about stalking, harassing, and committing acts of terror against Alamogordo citizens. They were acting very much like the German Gestapo and SS, which is why I call them yard Nazis. If you have seen it in the past, you recognize it in the present.

After my fire, the fire department told me that these people had become violent, caused a number of fires, including mine, and were working with "a gang from Mexico", making the yard Nazis an international criminal organization.

It should be obvious to anyone that for one or more persons to abuse the power of government to force you to make your property look the way they want your property to look by complaining to the government is blatantly unconstitutional. ANYONE abusing the power of government over other people is unconstitutional.

Science

The reason for this part in this statement is to prove that their code enforcement has nothing to do with real science and what they are forcing people to do is the exact opposite of what science says they should do or what we call bogus science and most people call fake science.

I request that the judge please have a Ph.D. in science, especially biology, from NMSU, UTEP, Eastern, or UNM read this entire statement to make sure that everything I tell you about science is good science and not bogus science so you will know that I don't lie. My science is good science.

I will keep this as short and simple as I can, covering just the basics.

First, why is a desert a desert?

The nutshell version is that a desert is a desert because it does not have enough water to grow enough vegetation to provide enough ground cover to prevent enough sunlight from hitting the ground, being absorbed by the ground, turned into heat, and heating the area and air so that, as the air moves around the area, it also heats and dries the area preventing there being enough water to keep it from being a desert.

This is really critical in New Mexico, especially Alamogordo, because we get more sunlight per square foot than all but 3 deserts in the US, therefore, more sunlight will be absorbed by the ground generating more heat per square foot.

Also, college physics teaches that the darker the surface, the more sunlight will be absorbed and the more heat will be generated. We also have to keep in mind that we need black asphalt on our streets and parking areas for engineering reasons concerning automobile use and safety.

This information plus common sense should tell you that the best way to live in a desert like Alamogordo is to have as much vegetation or "ground cover" covering the ground around homes as possible to decrease the heating effect as much as possible to keep the area as cool as possible and to protect the soil.

This is partly because, when sunlight hits vegetation, it doesn't generate heat, it causes a process call photosynthesis that causes the plants to create nutrients for grow.

In spite of this, the person across the street from me has 3 lots with almost 2 of those lots covered in black asphalt heating up her property, her home, the neighborhood, our homes, and driving up our cooling bills and she told me a year ago that her summer cooling bill is $400 per month, which far more than a poor person like me can afford.

If you were to put her land anywhere in this desert, it would be one of the hottest places in the desert, making the desert worse and less habitable.

In spite of this, her land is code compliant in violation of what science says and her land is making the neighborhood hotter and less habitable.

I figure it is because some oligarch makes money paving over and maintaining the asphalt on such property.

The people on the opposite side and across the alley from me have 2 lots, mostly covered with grey gravel, which is a little better than black asphalt. It would easily be one of the hotter pieces of land in this desert making the desert worse and less habitable and is heating up her land, her home, the neighborhood, and my home, driving up my cooling bill.

Her land is also code compliant in violation of what science says. I figure that is because some oligarch makes money covering people's land with gravel to heat the area up.

The DA told me several times that I should just remove all of the vegetation and have bare land to be code compliant but science says that is one of the worst things I could do to this hard packed clay.

For centuries, people have packed clay, like on my land, into molds and sun baked it to turn it into sun baked clay bricks, which water will not penetrate and nothing will grow in and it would be one of the hotter places in this desert heating up my land, my home, the neighborhood, and driving up all of our cooling bills but it would be code compliant. If I did what she says, my trailer would get so I hot I could not afford to pay the cooling bill and would have to live under my trailer, especially in this area.

The scientific truth is that sunlight and hot dry winds destroy this soil so that the soil itself needs to be protected from the sunlight and hot dry winds by vegetation. The sun cooks the water out of the soil, hardens the soil, turns the soil into a heat sump so that it will radiate heat into the area all night long, making the city less habitable.

Therefore, we must consider vegetation for ground cover and I already told you that the city deceptively calls the indigenous vegetation that grows here naturally "weeds" so people will not realize that the vegetation that is in violation of codes is the indigenous vegetation that is the most important vegetation in the basin because it is the backbone of the ecosystem in this basin, without which we couldn't even have an ecosystem.

You have to understand that birds have been migrating through this basin for thousands of years crapping seeds onto the ground from other areas to the north and south, most of which either will not grow in this hostile environment or, if they do grow, they won't survive in this hostile environment, which is why they are not now growing in this hostile environment. The indigenous vegetation growing here are the only plants that have survived this hostile environment over thousands of years. They are the indigenous vegetation for a reason.

I have already pointed out that their codes are forcing you to buy invasive species that require hundreds to thousands of dollars in replacement soils, fertilizers, and water every year to make the oligarchs more wealth and discriminate against the poor, when they could do like me, use science and indigenous vegetation to not buy replacement soils or fertilizers and to conserve water by not requiring water at all to also keep their city cooler, conserve electricity and gas for cooling and heating, and be a much healthier environment.

As a biologist, I am very proud of the very challenging task I have done by taking dead land, damaged from thousands of years of being a sun baked water shed, and naturally turn it into healthier land that has a greater density and variety of vegetation than any land I know of within at least a mile of my land in just a little over 20 years. That is a huge accomplishment.

Then I drove around town a little and noticed that almost everyone I saw in Walker Town is growing the same vegetation I was written up for growing and went to the rich side of town, where people are growing the same vegetation I was written up for growing telling me I have been singled out by the city for some reason, even before I began to fight back for the people, which is unconstitutional. All you have to do is drive around town to see that.

Gee, you don't think they are abusing their power by making up code violations to drive me off my land for some reason, do you?

They definitely are not equally enforcing the law for some reason, which is unconstitutional.

In conclusion, the City of Alamogordo is not using science but is using what we call bogus or fake science to deceive people into believing they are using real science so they can control the land to control the people so they can steal more money from more people faster because their program is only about deception, control, power, and greed and has nothing to do with real science.

The proof for that is that their codes are heating up the desert and our city, making it less habitable, damaging our soil and they are forcing people to grow invasive species that require much, much more water in a town that has to ration water, which is insane. These greedy, power mad oligarchs, politicians, and bureaucrats are destroying Alamogordo and don't know enough about real science to see it. All they can think about is how much more money they can make right now.

I will use real science to make some easy predictions because, if you have seen it in the past, you recognize it in the present.

Unless they are soon stopped, they will continue to heat up Alamogordo and destroy the soil in Alamogordo, making it less and less habitable, while using up more and more of our very finite water until we run out of water, in part by selling homes to people from places like California to increase demand for homes to increase prices for homes to increase their profits by bringing more people to Alamogordo to use more water. This is criminal mismanagement.

We can only use so much water and there won't be any left.

When they force you to grow plants that use much more water, while bringing more people here who will use more water and having so little water that we already have to ration water, it isn't if we are going to run out of water, but when.

Something very similar happened in Claunch, NM and I am watching it also happened in Albuquerque, NM but the greedy idiots running that place also do not know enough about real science to see what they are doing and the inevitable result. They are going to turn most of Albuquerque into a massive ghost town the way our greedy people in Alamogordo are right now about to turn Alamogordo into a ghost town where everyone will lose everything they have.

The irony is that these greedy rich people committing state and federal crimes to increase their wealth is just them increasing the amount of wealth they will lose when this town goes water broke and they lose everything they have.

You should study the socio-economics of such a disaster. It is far from being pretty. It will quickly turn Alamogordo into a living, panic driven Hell on Earth as people panic and flee for their lives because you can only live a few days without water, especially in a hot, dry desert.

When you water bankrupt a community, everyone, even the richest will lose everything because land without water is useless so that you can't even give it away and everyone will be forced to move to where there is water or die. There won't even be anywhere nearly enough moving vehicles like U-haul and Penske to get their belongs out of town so almost all of them will have to put what they can stuff into their cars and leave everything else behind.

When people start fleeing the town in panic, all of the businesses and banks will quickly go broke and there won't be enough tax revenues to continue the governing body for the City of Alamogordo so all of those people will lose their jobs and have to also flee.

But it will be much worse than that because of several things. First, you know that the State Government of New Mexico will send an investigation team down to see who did what to water break Alamogordo and they will quickly find out who committed the crimes that destroyed Alamogordo. All of those people will find themselves spending time in the state prison system.

Second, both Holloman AFB and White Sands Missile Range depend on Alamogordo in part to be able to carry out their military missions for national security and the criminals using this unconstitutional system to control and steal from the people and destroying Alamogordo are "compromising their missions" (that is the legal term the military uses), which is a threat to national security, so you know the FBI and probably also the US Military will send investigation teams here so the people causing this disaster will be facing numerous federal charges along with losing all of their wealth.

What little they do manage to save will be spent on attorneys trying to keep them out of prison and litigations for damages by the people whose lives they destroyed. They will lose everything they have.

This program clearly has nothing to do with science or they would never do what they are doing with their bogus science. Therefore, their program is completely unconstitutional and an abuse of power.

I realize that it may even be too late to save this town but I am trying.

Summary

What we need to do is to take the power the city is clearly abusing and can very easily abuse for any number of reasons and return that power to the people where it belongs in compliance with the US Constitution.

I am not a criminal for not obeying unconstitutional mandates; they are criminals for not obeying the US Constitution by forcing unconstitutional mandates on the people, which is a federal felony. Therefore all of their fake charges against me should be dismissed.

I request that the court make it official in a court of law that the legal definition for weeds must be the biological definition, which states: "Any plant that is on YOUR land that YOU do not want on YOUR land is a weed and any plant that YOU want on YOUR land is not a weed," which will return that power back to the people from the city because the people will get to determine which plants they want growing on their land and not the government.

That will return at least partial control of the land back to the people but much more needs to be done to return complete control of the land to the people so they can control their own land and not be controlled by their land.

I also request that the court make it official in a court of law that it is unconstitutional for the government to dictate the appearance of property to the people because that is completely subjective and can be too easily abused by the government the way it is right now being abused.

You have a right to make your land to look like what you want it to look like. I want my land to look like a beautiful New Mexico desert garden and you have the right to make your land look like what you want it to look like.

We have Picasso and Rembrandt, who have different likes and dislikes, so who gets to dictate to whom what their property looks like?

No one, because this is a Constitutional Republic and the US Constitution means more than the appearance of property. To dismiss or ignore the US Constitution for the appearance of property and to control property to control the people to steal more from the people automatically turns this government from a Constitutional Republic into a greedy, power mad tyranny, is a federal felony, and is an act of treason against the people. Therefore, the judiciary must uphold and enforce the US Constitution as per the requirements of the US Constitution.

Besides, no one has ever asked me what I was doing with my property. They always just see something they can make up charges for and write you up. That is too much power over the people.

Finally, I request that it be made official in a court of law that it is unconstitutional for one or more persons to abuse the power of government by complaining to the government to force YOU to make YOUR property look the way they want YOUR property to look.

That should be blatantly obvious.

Then I request that the court have the city investigated to make sure they are not using other such programs flying under the judicial radar to unconstitutionally abuse the power of the government over the people.

Wow, I had forgotten how well written that was. This is the first time I have read this since April 24 of this year. You just got very good lessons in law, Constitutional law, about me, and science. I also realized that this could still be under investigation with instructions to not comment on it until the investigation is completed but, hey, no one told me.

I am stunned because I did a much better job writing that than I remembered doing. I really laid down the law, didn't I? It had to be God working through me...again.

And I clearly remember keeping it simple and short. I could have easily written hundreds of pages on this.
