Court Case 2
This morning I woke to the realization that the reason God had me off the Internet for 10 days was so I could focus on writing the written closing statement for my court actions without the Internet and news distractions.
We had the state court hearing on March 22, she ordered that the DA have her written closing arguments to the judge and me by April 10, and I then had until April 24 to have my written statement to the judge and DA. The DA had her written closing statement to me written by March 26 and delivered to me by mail a few days later, my 74th birthday was April 13 and I lost my Internet service on April 14 until just hours after submitting my written closing statement on April 24. Gee, what a magic coincidence.
I also realized that I am supposed to update you as to what has gone on up to this point, which will be the rest of this essay and maybe another essay or two. You will find this very interesting because of the "intrigue" and seeing how God works things. Yahweh is brilliant and that is an understatement.
The way court room proceedings are supposed to work is that the DA presents their case without interruptions by the defense, then the defense presents its defense without interruptions by the DA, then the DA gets to present any arguments against the defense, then they both present closing statements in an organized and structured manner, you know, like civilized human beings and not barbaric pagans.
The DA saw to it that didn't happen by creating chaos and distractions during the defense to prevent an organized and structured presentation of my defense to deny me my Constitutional right to a fair trial, which is unconstitutional and illegal. They knew they could not permit me to present my defense in an organized and structured manner because they knew my defense would prove their program to be unconstitutional and shut their cash cow and control system down.
For more than 20 years I had been aware that this code enforcement program was unconstitutional but they were just minor infractions that didn't really cause anyone any harm and I was too busy fighting for my life with my prolonged illness.
In the Spring of 2022 that all changed when they took the program away from the Fire Department, created a new city department, and put it under the direct control of the city DA, who was very aggressive. I heard from a number of different people that she showed up in our neighborhood and literally bragged that "We are going to make you do what we say." When I heard that, I knew there was a problem.
As I saw more and more poor people getting written up for stupid things, I went around talking to some of those people about how they should stand up to the city and even get an attorney to file a class action law suit to stop it but I quickly learned that they didn't know enough about law or science to defend themselves in court and attorneys are so greedy today so that, if it doesn't make them truck loads of cash, most of them don't care about the US Constitution and people's right.
God caused me to realize that, if I got written up, I would have to use my knowledge about law and science to fight for the poor and middle classes but mostly for the poor. Someone had to fight for the most vulnerable people and God chose me, a sick, weak, impoverished old man fighting for his life, you know, like my life wasn't tough enough with my prolonged illness and poverty along with writing my blog.
Plus, I knew the city government here is corrupt but I had no idea just how corrupt. It is really bad here and, boy, has this been a lesson.
You also have to understand that I studied both New Mexico and Federal law but I do not know the function of their legal system, you know, the dos and don'ts, so I was at a serious disadvantage and have I learned a lot in the last 7 months.
In something the court sent me, it stated that, if I had any evidence, I was required to provide the DA with that evidence before the court hearing. The only evidence I had was the defense I was writing so I thought I was supposed to provide them with a copy of that so I posted that defense on this blog in September 2022 as "Court Case" and sent them a link to it. I now realize that was God warning them there was going to be a fight so they would prepare for that fight, forcing me to learn a lot.
Remember that I told you years ago that the small village of La Luz, New Mexico, just 7 miles north of Alamogordo, is one of the 5 most holy towns in the US for the occult and that most of the upper class trash and their puppets here are members of that Christian hating occult?
So I sent them a link to my defense on a Christian site and you know their first thought was, "It is time for holy war!" A lot of this town is run by demons. The last 7 months have been anything but easy.
If you know God, you know He is not going to choose some young, healthy, rich guy with 20 Ph.D.s to do the job so people will know it was God and not the man.
You also have to understand the basic court system in the US. You start with the city court, if you lose there, you appeal to a district state court, then appeal to the state Supreme Court, then appeal to a federal district court and finally appeal to the US Supreme Court.
We are going to start with the city court hearing, which I appealed to the district state court. It was clearly stated that the city court hearings are not recorded, which allows them to get away with anything they want.
Their attitude is that, if you complain about unfair or illegal proceedings against you, it is your word against the word of the judge but that is not how it is supposed to work, though it may often work that way. It is now obvious they have been abusing that system.
When someone commits a crime against you and you report that crime, that is "eye witness testimony" that a crime has been committed, justifying an investigation of that potential crime. One of a number of ways to investigate a crime committed by a court based on eye witness testimony is to get a list of everyone who has been in that court for the last 5 to 10 years and interrogate them to see if there is enough additional eye witness testimony to prosecute for crimes committed by the court.
Next, you have to understand that the hearing was not in a court room but was one of those video conference thingies where you sit in front of a computer in one room and they all sit in front of computers in other rooms, which makes all kinds of dirty tricks by the court possible.
The first thing the judge stated was that I was supposed to quietly listen to the DA present her case and then I would present my case so I quietly sat and listened to the DA present her case.
Less than one minute after I began presenting my defense, in defiance of the US Constitution and Federal Law, the judge rudely interrupted and said, "I have heard enough, you are guilty", telling me he clearly had decided before the hearing that I was guilty and was denying me my Constitutional right to a fair trial. I had not even presented 1% of my defense so I ignored him and kept presenting my defense, knowing it probably wouldn't matter but I was determined to go down fighting, also knowing I can appeal their city court decision.
As I continued to present my defense, it became obvious that the judge and DA were working together and probably texting each other to disrupt my defense with distractions and chaos, in violation of the US Constitution and Federal Law. We used to call this "railroading" someone and at one point I thought I had somehow teleported back into a Soviet Union courtroom. It was really bad and I fought as hard as I could to overcome their distractions and chaos they were both part of. There was no way I was going to get a fair trial in that court.
At 2 pm on February 2, 1972, I swore an oath that has no expiration date to up hold and defend the US Constitution against external and internal threats and I was now having to fight that battle as a sick, weak, impoverished old man in my early 70s with only God has my battle companion but He is all I need.
This was especially true whenever I pointed out that something was unconstitutional. One of them would interrupt, change the subject to something else, and I would answer that distraction and bring my defense back on subject. I was getting a clear message that they knew their program was unconstitutional and, of course they knew because they both have law degrees and passed the BAR exams so they knew when something was unconstitutional.
After the last thing I pointed out as being unconstitutional, the judge confirmed they knew, when he said, "These are our laws, if you live in Alamogordo, you will abide by them." The message was very clear that they know what they are doing is unconstitutional, the US Constitution does not apply in Alamogordo (only Satan's Law of "Do as you will"), you have no Constitutional rights in Alamogordo, and you will do as they say or else.
God's prophets are required to fight that holy war.
Then the judge taught me some other things as a warning that told me more about how incredibly corrupt the City of Alamogordo Government really is. Boy, was that an eye opener.
You see, they brilliantly picked this code enforcement program as a cover to hide their tyranny under because no one in law even bothers to check city code enforcement because the attitude is that no serious Constitutional violations could be committed with such an insignificant program just about weeds and debris so using such a program makes it possible for the city to "fly under the radar" for the higher courts so they don't even realize a micro dictatorship is in progress, in violation of the US Constitution. Because of that, these people have been having their own micro dictatorship unnoticed by the upper courts for more than a quarter of a century and they just got much worse a year ago.
How did the city do that?
He told me that he could fine me up to $500 per day, every day and could send me to jail for up to 90 days purely at his discretion and for any reason he wanted, you know, just like courts in the Soviet Union with their Gulag system. Shades of Stalin.
Let's do some math and see just how much power they have given themselves with this sweet, innocent code enforcement program and you have to keep in mind that the royals learned thousands of years ago that you control the land to control the people so the city gave themselves absolute control over the land to have maximum control over the people, you know, just like the European royals all did more than 1,000 years ago and the Founding Fathers of the US fought a war to get out from under.
To achieve this, they set up a system where they use vague terms like weeds, debris, junk, an eye sore, unsightly, and offensive, which can mean anything, along with bogus or fake science to fool people who have not studied any science in college, especially most judges, to believe that it is all based on science. They can make up any charge they want any time they want for any property they want based on the appearance of your property and bogus science.
That gives them absolute control and power over your land so they can abuse the control of your land to control you, which is unconstitutional.
I later realized that I am not just fighting for the poor people but for everyone because all good people are clueless about what is really going on and don't know enough to be able to fight it so God chose me. Following the city court hearing and until two weeks ago, I often felt I was smaller than David fighting a giant bigger than Goliath all alone but it doesn't matter how small you are or how big the giant is, just how big God is and Yahweh is infinite.
BTW, the bigger the giant is, the more noise they make when they hit the ground.
You always ask God in prayer what He wants you to do and how He wants you to do it and then you do your best and God does the rest.
Let's say that judge fines me $500 a day for 30 days, that is $15,000, which is much more than poor people like me can pay. If he fines me $500 a day and puts me in jail for 90 days, I will get out of jail owing the city $45,000 in trumped up charges or city land taxes, which few people in this city can pay, including me.
If you cannot pay their trumped up fines or city land taxes for fake charges they can make up any time they want for any land they want, they can use that to justify seizing your land and selling it "for their money", making you homeless and destitute, you know, just like the royals did to your ancestors for thousands of years, which is unconstitutional. They can easily destroy you with fake charges they can make up at any time for anything and just claim. It doesn't have to be true, they just have to claim it is true and, in their city court, you are instantly guilty.
Also, it is a great way to levy taxes on random people or whomever they want without the people realizing they were just unconstitutionally taxed.
Let me give you a few examples.
If they fine you $500 per month for 12 months, that is $6,000 per year in city land taxes and, if they do that to 1,000 land owners, of which there are more than 10,000 land owners in Alamogordo, that will be $6 million dollars generated in revenues for the city in just one year with city land taxes, which is just a wee bit of motivation for corruption for a small town.
It is an easy and deceptive way to increase taxes or city revenues on random people by making them believe they did something wrong. If the city wants another $5 to $10 million dollars, they just send the code enforcer out to write up a bunch of people by making up whatever charges they want until they get the money they want.
In Alamogordo, you cannot own your property, the city uses their codes to control and "own" the property so that they just give you permission to live on and use that property, which is in violation of the US Constitution.
Talk about abuse of government power. This is not about weeds and debris, it is about the US Constitution.
Do you believe me yet that they have created a micro dictatorship under the guise of an innocent code enforcement program just about weeds and debris flying under the radar of the upper courts?
But there is more.
Then I told the city court the biological definition for a weed, which is that "any plant on your property that you do not want on your property is a weed and any plant you want on your property is not a weed" and the judge told me, "The definition for a weed is vague and it is whatever we want it to be," telling me that their code enforcer can pick any plant in any yard, say it is a weed for any number of reasons and they can write you up for it, giving them unconstitutional absolute control over every property in Alamogordo and them using control of that property to control the people, you know, just like the British Royal Surf System.
The full impact of that didn't hit me until we were in the state court and the DA provided us with copies of the codes and the definition of a weed included but is not limited to: rank, noxious, poisonous, harmful, unhealthful vegetation, or any growth whatsoever of an offensive or unsightly nature.
All they have to do is CLAIM any of that and any plant can be classified as a weed and you should know that better than 90% of the plants on this planet, if consumed by humans, will make you sick or kill you, therefore, they are "noxious, poisonous, harmful, and unhealthful vegetation". That includes almost all plants growing in people's yards and being sold by businesses.
They even listed that trees can be listed as debris with no requirements concerning the tree's health or it being alive or dead. Any tree in your yard can be branded as debris and you can be written up for it.
Basically, they can send the code enforcer to write up your property and he can pick any vegetation, claim any of those or other things, and, by their laws, that is a weed and they can write you up. They can use those vague terms and definitions to claim a rose bush, a tree, or even just your lawn is a weed because they claim it is unhealthy and they can write you up. It is brilliantly done and I was stunned.
They can do the same thing with vague terms like debris, junk, offensive, an eye sore, and others. It can be anything they say it is and I have become convinced that your yard could be just dirt with one rock in it and they can claim the rock is debris to write you up for a crime.
Do you see how their system has given them absolute control over all land in Alamogordo to abuse to control you?
They also brilliantly designed the system to increase profits for the oligarchs by branding all indigenous vegetation as weeds so you cannot grow them in your yard. This also causes people who have not studied biology in college to not realize that what they are really doing is branding indigenous vegetation as weeds so you can only grow invasive species you purchase from the oligarchs, without realizing they are invasive species because most people just think they "are not weeds". The military calls this psychological warfare against the people.
This forces the people to buy their invasive species from businesses owned by the oligarchs, which makes the oligarchs more money. Since those invasive species are also rarely drought or heat tolerant they tend to die in this high altitude desert, which makes the oligarchs more money because you have to buy replacement plants from them.
Then most of those invasive species tend to not grow as well or at all in the local soil, especially in "Walker Town" south of highway 70 and west of highway 54, so you are also required to buy replacement soils for hundreds to thousands of dollars from the oligarchs, which makes them more money, and you have to buy fertilizers and plant food for hundreds of dollars from the oligarchs, which makes them even more money, especially when you multiply that out for thousands of homes.
With all of that, most of those invasive species are not drought tolerant so you have to put much more water on them, hundreds to thousands of dollars of water per year, in a high altitude desert with enough of a water shortage that they force you to ration water every year but that is OK as long as it makes the oligarchs more money.
So what if you eventually increase water usage to where you run out of water turning Alamogordo into a ghost town like Claunch, NM? Does forcing people to buy and grow invasive species, which require a lot of water in an area where they have to ration water, make sense to anyone?
Note that, in Wild Life Management, we studied Claunch, NM, which had been a town of 15,000 until they ran out of water. The last I heard, there were only 8 to 10 people living there.
I didn't even get 25% of my very disrupted and chaotic defense stated when the judge again interrupted me and said, "I have heard enough, you are guilty".
Boy, was that a stunning lesson in corruption but there was even more to learn. I had from September 2022 to March 22, 2023 to learn, research, and build a better defense, learn the system, while preparing for the worse and getting much better.
I appealed to a state district court, which will be in my next essay and it gets interesting, showing how God works in unusual ways. I am also going to show you how God has shown me to fight it.
It has only been a 7 month fight but it seems like a much longer (a couple of years) and harder battle, especially in having to do it all alone, learning things the hard way, with no help but God. Fortunately, He is good enough. We seem to make a pretty good team.
One thing God has taught me with this is that, with God, one person can make a difference, so be that person.
